Terms of Service

These Terms of Service govern your use of Focus Pet.

By downloading, installing, creating an account for, purchasing Focus Pro through, or otherwise using Focus Pet, you agree to these Terms.

If you do not agree to these Terms, do not use Focus Pet.

Using Focus Pet

Focus Pet is a desktop focus and productivity companion for supported Windows and macOS computers.

Focus Pet provides tools intended to help you manage focus sessions, reduce distractions, track progress, and interact with Focus Pet's game and customization features.

Core Focus Pet features are available without purchasing Focus Pro. Certain features, including Deep Focus and other premium features identified in the application, may require an active Focus Pro entitlement.

Focus Pet is provided as a productivity aid. We do not guarantee that Focus Pet will prevent every distraction, block every application or website, or operate identically with every application, browser, operating-system version, hardware configuration, or third-party service.

Application and Website Detection

During an active focus session, Focus Pet may determine which application is currently active on your computer.

For supported browsers, Focus Pet may also determine the active website domain in order to evaluate the Allow List or Block List selected for your focus session.

This functionality may use operating-system features such as Windows application APIs or macOS Accessibility APIs.

Focus Pet uses this information to:

• evaluate your selected focus rules;
• determine whether your current activity is focused, distracted, or restricted;
• provide Normal Focus and Deep Focus behavior;
• track focus-session progress;
• calculate rewards, streaks, and focus statistics;
• display relevant Focus Pet notifications or warnings.

Focus Pet does not use application or website detection to intentionally read:

• the contents of your files or documents;
• the contents of webpages;
• text entered into applications or websites;
• passwords or other credentials;
• private messages;
• keystrokes;
• screenshots;
• screen recordings.

Focus Pet's website rules operate on domains rather than storing full browsing URLs as focus-rule history.

Some detection or enforcement functionality may depend on operating-system permissions, supported browsers, application behavior, or other technical limitations. Focus Pet does not guarantee that every application or website can always be detected, blocked, closed, or otherwise controlled successfully.

Normal Focus and Deep Focus

Focus Pet may offer multiple focus modes.

Normal Focus is intended to provide supportive focus tracking. Activity outside your selected rules may be treated as a distraction and may affect Focus Pet rewards or statistics.

Deep Focus provides stronger restriction behavior and may attempt to warn about, close, or otherwise enforce restrictions against applications or websites according to the features available on the operating system and the settings selected by the user.

Deep Focus is a Focus Pro feature unless otherwise stated in the application.

You remain responsible for saving your work and choosing appropriate focus settings. Although Focus Pet is designed to prefer safe and graceful behavior, certain enforcement features may close applications when enabled.

Do not rely on Focus Pet as the sole method of protecting important work, preventing access to applications, or enforcing time-sensitive restrictions.

Accounts and Guest Mode

Creating a Focus Pet account is optional.

You may use Focus Pet in guest mode without creating an account. Guest-mode progress is generally stored locally on the device and does not use Focus Pet cloud backup.

If you create an account, Focus Pet may provide features including:

• cloud backup and restore;
• account authentication;
• Focus Pro entitlement association;
• restoring supported progress and settings when you sign in on another supported device.

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.

You agree to provide accurate account information and not to impersonate another person or attempt to access another user's account.

Single-Active-Device Account Model

Focus Pet accounts currently use a single-active-device model.

You may sign in to your Focus Pet account on different supported devices over time, but only one device may hold the active authenticated Focus Pet session at a time.

Signing in on another device may require you to choose whether to take over the active account session. If you do so, the previously active device may be signed out.

Focus Pet does not currently promise simultaneous active use of the same account across multiple devices.

Cloud Backup

If you choose to use a Focus Pet account, supported game progress and settings may be backed up using Focus Pet's cloud services.

Cloud backup is intended to help restore supported Focus Pet data when signing in on another supported device.

Cloud synchronization and restore depend on network availability and third-party service availability. Although Focus Pet is designed to protect user progress, we do not guarantee that cloud synchronization will always be instantaneous, uninterrupted, or free from errors.

You should not use Focus Pet cloud backup as the only backup system for information that is independently important to you.

Focus Pro

Focus Pro is an optional paid upgrade that provides access to premium Focus Pet functionality, including Deep Focus and other features identified in the application.

Available Focus Pro plans, prices, billing periods, and included features are displayed at the time of purchase.

Focus Pet may offer:

• monthly subscription plans;
• yearly subscription plans;
• lifetime or other one-time purchase options.

The plans actually available to you are the plans displayed in Focus Pet or during checkout at the time of purchase.

Payments and Stripe

Focus Pro payments are processed through Stripe.

When you purchase Focus Pro, Focus Pet may open Stripe Checkout in your web browser.

Stripe may collect and process payment information under Stripe's own terms and privacy policy.

Focus Pet does not directly need to store your complete payment-card details in its own application database.

Stripe is responsible for payment processing and billing events, including applicable subscription payments, renewals, failed payments, cancellations, and payment-method management.

Recurring Subscriptions

If you purchase a recurring Focus Pro subscription, such as a monthly or yearly plan, the subscription will automatically renew according to the terms shown during checkout unless it is cancelled before renewal.

Your payment method may be charged at each renewal according to the price and billing period presented at purchase, subject to any changes permitted by applicable law and communicated as required.

You can manage supported billing and subscription settings through the billing-management options provided by Focus Pet and Stripe.

Cancelling a recurring subscription generally prevents future renewal. Unless otherwise required by applicable law or stated at the time of cancellation, cancellation does not necessarily remove access immediately; you may retain Focus Pro access through the end of the period you already paid for.

Lifetime Purchases

If Focus Pet offers a lifetime Focus Pro purchase, that purchase is a one-time payment for the Focus Pro access described at the time of purchase.

"Lifetime" refers to access for the supported lifetime of the Focus Pet product or service and does not guarantee that every current feature, operating system, third-party integration, or technical implementation will remain unchanged forever.

Failed or Past-Due Payments

If a recurring payment fails, Stripe may retry the payment according to its billing settings.

Focus Pet may preserve access temporarily while a payment remains in a retry or past-due state, and access may later be limited or removed if the subscription becomes unpaid, expires, is cancelled, or otherwise no longer grants access.

Refunds

Except where required by applicable law or otherwise expressly stated at the time of purchase, purchases are generally subject to the refund rules communicated through Focus Pet, Stripe, or the applicable purchase flow.

Nothing in these Terms limits any refund, cancellation, or consumer-protection rights that cannot legally be waived in your jurisdiction.

Changes to Focus Pro and Pricing

We may change the features included in Focus Pro or the prices offered for future purchases or renewal periods.

Any changes will be handled in accordance with applicable law and any notice requirements that apply.

A change to future pricing does not retroactively change the amount already charged for a completed purchase.

Third-Party Services

Focus Pet relies on third-party services to provide certain functionality.

These currently include:

Supabase

Supabase is used for functionality such as:

• user authentication;
• cloud backup and restore;
• account/session coordination;
• Focus Pro entitlement information;
• server-side functionality supporting Focus Pro.

Stripe

Stripe is used for functionality such as:

• Focus Pro Checkout;
• payment processing;
• recurring subscription billing;
• one-time Focus Pro payments where offered;
• payment-method management;
• subscription management;
• Stripe's Customer Portal.

Third-party services are governed by their own terms, privacy policies, availability, and technical requirements.

We are not responsible for outages, changes, or failures caused solely by third-party services outside our reasonable control.

Updates and Availability

We may update Focus Pet from time to time to:

• add or remove features;
• improve reliability or security;
• support new operating-system versions;
• modify Focus Pro functionality;
• fix bugs;
• change the user experience.

Some updates may be necessary to continue using certain features.

We may modify, suspend, or discontinue parts of Focus Pet where reasonably necessary.

We do not guarantee that Focus Pet will remain compatible with every operating-system version, browser, application, device, hardware configuration, or third-party integration indefinitely.

Acceptable Use

You agree not to:

• use Focus Pet for unlawful purposes;
• interfere with or attempt to disrupt Focus Pet's services or infrastructure;
• attempt to gain unauthorized access to another user's account or Focus Pet systems;
• misuse Focus Pet in a way that could damage, disable, overload, or impair the service;
• attempt to bypass payment, account, entitlement, or access-control systems;
• distribute malicious software through or in connection with Focus Pet;
• reverse engineer, decompile, or modify Focus Pet except where such restrictions are prohibited by applicable law.

Intellectual Property

Focus Pet, including its software, design, artwork, graphics, branding, characters, text, and other original content, is owned by Focus Pet or its applicable licensors and is protected by applicable intellectual-property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable right to use Focus Pet for its intended purpose.

These Terms do not transfer ownership of Focus Pet or its intellectual property to you.

Account Suspension or Termination

We may suspend or terminate access to account-based or paid features if reasonably necessary because of:

• fraud;
• abuse;
• unlawful activity;
• unauthorized access;
• attempts to bypass payment or entitlement systems;
• serious or repeated violations of these Terms;
• security risks to Focus Pet or other users.

Where reasonable and legally required, we may provide notice or an opportunity to resolve the issue.

You may stop using Focus Pet at any time.

Account-data deletion requests may be submitted as described in the Focus Pet Privacy Policy or by contacting help@tryfocuspet.com.

Disclaimers

Focus Pet is provided on an "as is" and "as available" basis to the extent permitted by law.

We do not guarantee that Focus Pet will:

• always be available;
• operate without bugs or interruptions;
• detect every application or website;
• successfully block or close every restricted application or website;
• prevent all distractions;
• preserve every unsaved change in third-party applications;
• work with every operating-system update or third-party application.

Focus Pet is a productivity tool and is not intended to provide medical, legal, financial, safety-critical, or emergency services.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer-protection law.

Limitation of Liability

To the maximum extent permitted by applicable law, Focus Pet and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Focus Pet.

This may include losses resulting from:

• loss of data;
• lost productivity;
• interruption of service;
• third-party software behavior;
• applications being closed through enforcement features you enabled;
• inability to access Focus Pet or Focus Pro;
• third-party service outages.

Where liability cannot legally be excluded, liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Privacy

Your use of Focus Pet is also subject to the Focus Pet Privacy Policy.

The Privacy Policy explains how Focus Pet processes information, including application and website detection, optional accounts, cloud backup, Supabase, and Stripe.

Children's Use

You may use Focus Pet only if you are legally permitted to enter into these Terms in your jurisdiction.

If applicable law requires a parent or guardian to consent to your use of Focus Pet, you may only use Focus Pet with that consent.

Changes to These Terms

We may update these Terms as Focus Pet changes.

When we make changes, we will update the Last updated date at the top of this page.

If a change is material, we may provide additional notice where appropriate or required by law.

Your continued use of Focus Pet after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Governing Law

These Terms are governed by the laws applicable to the operator of Focus Pet, subject to any mandatory consumer-protection rights or laws that apply based on your location.

Nothing in this section deprives you of protections that cannot legally be waived under the laws that apply to you.
